Terms of Service

You must be at least 18 years old to use iVUniverse. By using the platform you represent that you meet this requirement. iVUniverse does not knowingly collect data from minors.

You are responsible for maintaining the security of your account credentials. You must not share your password or allow others to access your account. Notify us immediately at [email protected] if you suspect unauthorised access.

You may not create multiple accounts to circumvent restrictions, use automated tools to create accounts, or impersonate other users or public figures.

You retain ownership of content you post on iVUniverse. By posting content you grant us a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote that content within the platform.

You agree not to post content that:

• Infringes any third party's intellectual property or privacy rights
• Contains hate speech, harassment, or threats
• Is sexually explicit or involves minors in any inappropriate way
• Promotes illegal activity
• Is spam, misinformation, or deliberately misleading

We reserve the right to remove content that violates these Terms without prior notice.

iVUniverse offers free and paid membership tiers. Paid subscriptions are billed in advance on the billing cycle you select. Prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

Subscriptions renew automatically for the same period unless cancelled from your account settings before the renewal date. You may cancel at any time; cancellation stops future renewals, and your access continues until the end of the current paid period.

Refunds. Because iVUniverse provides digital services delivered immediately upon purchase, paid periods are generally non-refundable once the period has begun or a paid feature has been used. We will nonetheless issue a refund where required by applicable law, and at our discretion in the case of a duplicate charge, a proven billing error, or our failure to deliver a paid feature. Approved refunds are returned to the original payment method within seven (7) to fourteen (14) business days. To request a refund, contact [email protected] within seven (7) days of the charge.

The iVUniverse name, logo, design, and platform code are the intellectual property of infinite VARIABLE Pvt Ltd. You may not reproduce, distribute, or create derivative works from our proprietary assets without written permission.

We may suspend or terminate your account at any time for violations of these Terms or for any conduct we determine is harmful to the platform or its community. You may close your account at any time from your settings.

iVRadio is a directory and connection facilitator, not a broadcaster. The radio stations and podcasts surfaced through iVRadio are operated by independent third parties. We do not own, host, transcode, cache, record, or otherwise reproduce their audio content. Our role is limited to (a) indexing publicly available stream URLs published by these broadcasters, (b) presenting them on an interactive geographical interface, and (c) acting as a thin connection proxy where required to satisfy browser cross-origin policies. Bytes pass through our origin unmodified.

We operate as a “service provider” or “intermediary” under applicable safe-harbor regimes, including but not limited to: the Information Technology Act 2000 (India) § 79, the Digital Millennium Copyright Act § 512 (United States), the EU Copyright Directive (EU) 2019/790 Art 17, and equivalent provisions in other jurisdictions. We do not select, edit, or curate the audio content broadcast by any station. Editorial responsibility for broadcast content rests entirely with the originating broadcaster.

Where a broadcaster has signalled to us a geographical, temporal, or licensing restriction on their stream, we honour that signal. We do not knowingly route around any broadcaster’s access controls. Where we discover that a stream is no longer authorised for redistribution, we remove the listing promptly and permanently from the catalog.

Broadcasters or rights-holders who believe a stream listed on iVRadio is unauthorised, misattributed, or otherwise infringing may submit a takedown request to [email protected] with the following:

• Identity of the rights-holder and their authority to act.
• The exact station name and stream URL as listed on iVRadio.
• Description of the alleged infringement or unauthorised redistribution.
• A statement made in good faith that the use is not authorised by the rights-holder, their agent, or applicable law.
• A statement, under penalty of perjury, that the information is accurate.
• Signature (physical or electronic).

We commit to good-faith review and action within seven (7) calendar days of a complete request, often the same day. We maintain an audit log of every station-id served through our connection proxy, enabling targeted removal.

iVUniverse and iVRadio are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant uninterrupted operation, error-free transmission, the suitability of any third-party broadcast for any particular purpose, the accuracy or completeness of broadcaster-supplied metadata, nor the continued availability of any listed station.

To the maximum extent permitted by applicable law, infinite VARIABLE Pvt Ltd, its directors, officers, employees, shareholders, agents, contractors, and affiliated parties shall not be liable for: (i) any indirect, incidental, special, consequential, exemplary, or punitive damages; (ii) any loss of profits, revenue, data, goodwill, or business opportunity; (iii) any content, conduct, statement, or omission by a third-party broadcaster surfaced through iVRadio; (iv) any unauthorised access to, interception of, or alteration of your transmissions or data; (v) any defamatory, offensive, infringing, or illegal conduct of any third party using the platform; (vi) any damages arising from your reliance on broadcaster-supplied geographical or licensing metadata. This limitation applies to all claims of any nature, whether in contract, tort (including negligence), strict liability, statute, or otherwise, even if foreseeable and even if we have been advised of the possibility of such damages.

User indemnity. You agree to defend, indemnify, and hold harmless infinite VARIABLE Pvt Ltd and the parties named above from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the platform, (b) your breach of these Terms, (c) your violation of any applicable law or third-party right, or (d) any user content you submit.

Where any limitation in this Section is held unenforceable, our aggregate liability to you for any cause of action shall not exceed the greater of (i) INR 1,000 or (ii) the total amount you paid us in the twelve months preceding the claim.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.

Good-faith resolution first. Before commencing any formal proceeding, you and we agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform amicably, by written notice to [email protected], within thirty (30) days of the notice.

Arbitration. Any dispute not resolved within that period shall be finally settled by binding arbitration under the Arbitration and Conciliation Act, 1996 (India), as amended. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement (failing which, as provided under the Act); the seat and venue of arbitration shall be Pune, Maharashtra, India; the language shall be English; and the arbitral award shall be final and binding on both parties.

Subject to the arbitration agreement above, the courts at Pune, Maharashtra, India shall have exclusive jurisdiction over any matter not subject to arbitration, including applications for interim or injunctive relief and the enforcement of an arbitral award.

We may update these Terms from time to time. We will provide reasonable notice of material changes. Continued use of iVUniverse after the effective date constitutes your acceptance of the updated Terms.

We are not liable for any failure or delay in performing our obligations under these Terms where it results from a cause beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, civil unrest, strikes or labour disputes, governmental action or restriction, power or telecommunications failure, or the outage or failure of an internet-service provider, hosting provider, or other third-party service on which the platform depends.

Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the platform and supersede any prior agreements or understandings.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, or sale of assets.
